批评性体裁分析视角下的中文刑事判决书研究

Abstract

从批评性体裁分析的视角出发对中文刑事判决书进行分析能够从多维度理解判决书这一专业法律话语。文章在整合语篇和体裁两个角度的基础上，从语篇- 体裁视角对语料进行表层描述，总结出中文刑事判决书的体裁结构、语步特征；其次从专业实践视角出发，分析主审法官为了达到专业目的是如何将不同体裁进行杂糅整合的，即考察判决书文本中的篇际互文性；最后从专业文化角度出发考察文本背后的社会文化机制。
